Cancellation, Refund, and Right of Withdrawal Policy

Introduction and Legal Validity

This policy is governed by German and European consumer protection laws regarding distance selling contracts (Fernabsatzverträge) in accordance with the German Civil Code (Bürgerliches Gesetzbuch - BGB). These terms apply strictly to all students (consumers) registering for services on the Loghati.de platform.


Classification of Educational Services

The platform categorizes its educational services into two distinct legal frameworks:

  • A. Live Training Services (Dienstleistungen): This includes group courses (Cohorts), live conversation sessions, and specialized integration courses with live instructors.
  • B. Digital Content (Digitale Inhalte): This includes the "Loghati AI" application, automated grammar courses, and pre-recorded training sessions.


Statutory Right of Withdrawal (Widerrufsrecht)

Students residing within Germany and the European Union have a legal right to withdraw from this contract within 14 days from the date of the digital purchase without giving any reason. The following conditions apply strictly:

First: In the case of "Live Training Services & Sessions":

  • If the student requests to exercise their right of withdrawal within the statutory 14-day window, but the course has already commenced at their explicit request, the right of withdrawal is not entirely lost. However, the student shall be legally obligated to pay a proportional compensation (Wertersatz) to the platform. This amount will correspond to the value of the live sessions already delivered or made available up to the moment the withdrawal notice was sent.

Second: In the case of "Digital Content & Mobile Applications (Loghati AI / Recorded Courses)":

  • The statutory right of withdrawal (Widerrufsrecht) expires immediately and completely as soon as the student begins downloading the content, logs into the app for the first time, or accesses the pre-recorded educational materials. This is provided that the student explicitly consented at the time of checkout to the immediate execution of the service and acknowledged the subsequent loss of their withdrawal right.


Cancellation and Rescheduling Policy for Individual Sessions (Single Sessions)

Because the platform allocates instructor time and reserves digital classrooms in advance, any cancellation or rescheduling of private sessions is subject to the rules of "Default of Acceptance" (Annahmeverzug) under § 615 BGB:

  • Cancellation 24 hours or more before the session: The student has the right to reschedule the session free of charge via the platform or request a full refund of the session fee.
  • Cancellation less than 24 hours before the session (Late Cancellation): The student is not entitled to a refund or free rescheduling, as the seat and instructor's time cannot be reallocated. The session fee will be charged in full. Any rescheduling within this window is treated strictly as an act of goodwill (Kulanz) and remains entirely separate from any legal obligation.


Non-Attendance / No-Show

If a student fails to attend a scheduled live session or is delayed by more than 15 minutes, the instructor's obligation is considered fulfilled by virtue of their availability (Vergütung trotz Nichtteilnahme). The session will be marked as fully completed, and the student shall have no right to a refund, credit, or compensation.


Session Cancellation by the Instructor or the Platform

In the event that a session is canceled by the instructor or due to a central technical failure originating from the platform, Loghati.de commits to providing an immediate alternative scheduling slot that fits the student’s availability or issuing a full financial refund for the canceled session without any deductions.


Group Programs and Fixed Cohorts

  • Before the Cohort officially begins: The student has the right to cancel their enrollment and receive a full refund within the statutory withdrawal window (14 days from the purchase date).
  • After the Cohort officially begins and access is granted: No cancellation or full refund will be permitted due to fixed operational seating and report allocations. Exceptions are strictly made for verified cases of force majeure (e.g., prolonged medical illness), which must be legally supported by an official German medical certificate (Attest). In such cases, the account may be frozen or credited toward a future cohort.

Refund Request Procedures and Timelines

  • Withdrawal or cancellation requests must be submitted in a clear written format via the official email (e.g., support@loghati.de) or through the official ticketing system inside the Loghati Workspace.
  • The administration will review and respond to the request within a period not exceeding 5 to 10 business days.




Financial Refund Methods

  • The platform is legally obligated to return any approved refund amounts using the exact same payment method that the student used for the original transaction (Stripe, PayPal, or Revolut), in accordance with § 355 Abs. 3 BGB.
  • Loghati.de will not charge the student any additional administrative fees for processing the refund. However, the platform is not responsible for any currency exchange fluctuations or cross-border transaction fees imposed by the student's local bank.
